Terms and Conditions (AGB)

1. Scope

These Terms and Conditions (hereinafter “Terms”) apply to all orders placed through the online shop of Carma – Carla Marcus (hereinafter “the Seller”) at www.carma-ohana.com.

The offer is directed exclusively at consumers within the meaning of § 13 of the German Civil Code (BGB), i.e. natural persons who enter into a legal transaction for purposes that are predominantly private and not commercial.

3. Conclusion of Contract

  1. The presentation of products in the online shop constitutes a binding offer to purchase.

  2. Customers may place products in the shopping cart without obligation and review or correct their entries at any time before submitting the order.

  3. By clicking the button “Buy now”, the customer accepts the offer and enters into a binding contract.

  4. After submitting the order, the customer automatically receives an email confirming receipt of the order. This confirmation does not yet constitute acceptance of the contract. The contract is concluded only once a separate order or shipping confirmation is sent.

  5. The contract can be concluded in German or English.

4. Delivery and Availability

  1. Deliveries are made via DHL or another equivalent shipping provider.

  2. Shipping is available within Germany, the EU, Switzerland, and internationally upon request. Available destinations and shipping costs are displayed during checkout.

  3. Delivery times are specified in each product description.

  4. For pre-orders (e.g. items marked “Shipping end of November”), dispatch will take place as soon as the goods are available. If the delivery date changes, the customer will be informed promptly.

  5. If an item becomes permanently unavailable, the customer will be notified, and any payment already made will be refunded immediately.

5. Prices and Shipping Costs

  1. All prices are final prices in accordance with § 19 UStG (small business regulation). No VAT is charged.

  2. Additional shipping costs apply and are displayed during the order process.

  3. Shipping costs are borne by the customer.

  4. For deliveries outside the EU, additional customs duties, taxes, or import fees may apply. These are the responsibility of the customer.

6. Payment Methods

The following payment methods are available in the Carma online shop:

  • Shop Pay

  • PayPal

  • Credit Card

  • Klarna (Instant Transfer / Pay Later, if available)

  • Apple Pay

  • EPS

Payment processing is handled by the respective provider according to their terms and conditions.

7. Retention of Title

The goods remain the property of Carma – Carla Marcus until payment has been made in full.

8. Right of Withdrawal and Returns

Right of Withdrawal

Consumers have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period begins on the day the customer, or a third party designated by the customer, has taken possession of the goods.

Return Policy

Returns must be sent at the customer’s own expense to the following address:
Carla Marcus, Obere Immengasse 2, 88690 Uhldingen, Germany.

Returned items are accepted only if they are unused, unopened, and in their original packaging.

Opened or used yoga mats are excluded from the right of withdrawal for hygiene reasons (§ 312g (2) No. 3 BGB).

Once the returned goods have been inspected, the refund will be issued using the same payment method used for the original purchase.

9. Warranty for Defects

The statutory warranty rights under German law apply.
In the event of a defect, the customer has the right to subsequent performance (replacement or repair).
If this is not possible, the customer may withdraw from the contract or request a price reduction.

10. Liability

  1. Claims for damages are excluded unless they are based on intent or gross negligence.

  2. Liability for simple negligence is limited to typical, foreseeable damages.

  3. This limitation of liability does not apply in cases of injury to life, body, or health.

11. Data Protection

Personal data are processed solely in accordance with applicable data protection laws (GDPR).

12. Final Provisions

  1. German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

  2. Should any provision of these Terms be invalid, the remainder of the contract remains valid.

  3. The place of jurisdiction for all disputes, where legally permissible, is the registered address of the Seller.

In case of discrepancies between the German and English versions of these Terms, the German version shall prevail.
